How Morning Health uses cookies, pixel tags, local storage and similar technologies on our site — what each category does, how to control them, and how to change your preferences.

OVERVIEW. This Cookie Policy explains how Morning Health uses cookies, pixel tags, local storage and similar technologies (collectively, "Cookies") on the Morning Health website at https://www.morninghealth.ai/ (the "Site") and the related SaaS platform and Services accessed under any Self-Serve Plan (collectively, the "Services", as defined in the T&C). For broader information about how Morning Health collects, uses, discloses and protects personal data, please refer to our Privacy Policy at morninghealth.ai/en/privacy, which is incorporated herein by reference. Capitalized terms not defined herein have the meaning given in the T&C and the Privacy Policy.

1What Are Cookies?

1.1. Definition. Cookies are small text files that are placed on your computer or mobile device when you visit a website. Cookies contain information that can later be read by a web server in the domain that issued the Cookie. Website owners use Cookies for a variety of reasons, including to enable websites to function (or function more efficiently), to provide personalized content, to deliver advertising, and to generate website analytics.

1.2. Session vs. persistent. Cookies are typically classified as either "session cookies", which are automatically deleted when you close your browser, or "persistent cookies", which remain on your device until you delete them or they expire.

1.3. First-party vs. third-party. Cookies set by the website owner (in this case, Morning Health) are called "first-party cookies". Only Morning Health can access the first-party cookies we set. Cookies set by parties other than the website owner are called "third-party cookies". Third-party cookies enable third-party features or functionality to be provided on or through the Site (e.g., analytics, interactive content, marketing measurement). The parties that set these third-party cookies can recognize your device both when it visits the Site and when it visits other websites that have partnered with them.

1.4. Similar technologies. In addition to Cookies, Morning Health may use other similar technologies, including:

  • Web beacons (sometimes called "tracking pixels" or "clear gifs"): tiny graphics files containing a unique identifier that enable Morning Health to recognize when someone has visited the Site or opened an email Morning Health has sent.
  • Local storage (including LocalStorage and SessionStorage): technologies that enable a website or application to store information locally on your device to enable certain functionality, remember preferences, or speed up site performance.
  • Software development kits (SDKs): code libraries embedded in mobile applications that perform analogous functions to cookies in a mobile-app context.
  • References to "Cookies" in this Cookie Policy include all of the above technologies, unless the context clearly indicates otherwise.

    2Why Morning Health Uses Cookies

    2.1. Purposes. Morning Health uses Cookies for several reasons, including:

  • to enable the Site and the Services to operate and to provide functionality you have requested (Strictly Necessary);
  • to remember choices you make and personalize your experience (Functional);
  • to understand how the Site and the Services are used so we can measure, debug and improve them (Analytics);
  • where applicable and subject to your consent, to support marketing and attribution of new sign-ups to marketing channels (Marketing).
  • 2.2. Strictly Necessary Cookies. Strictly Necessary Cookies are required for technical reasons that are essential for the Site and the Services to operate and to provide user-requested functionality. These Cookies cannot be switched off in our systems. You can set your browser to block or alert you about these Cookies, but some parts of the Site or the Services may not work if you do so.

    3Categories of Cookies We Use

    The specific types of first- and third-party Cookies served through the Site and the Services and the purposes they perform are described in the table below.

    Category

    Description

    Strictly Necessary

    Essential to provide the Site and the Services and to enable core functionality such as authentication, session management, security, load balancing, fraud prevention and recordkeeping of cookie preferences. Cannot be switched off.

    Functional

    Enable enhanced functionality and personalization, such as language preferences, in-product chat / help widgets, and feature flags. May be set by Morning Health or by third-party providers whose services Morning Health embeds in the Site or the Services. If you do not allow these Cookies, some functions may not work properly. Not used in mobile applications.

    Analytics

    Allow Morning Health to count visits and traffic sources so that we can measure and improve the performance and functionality of the Site and the Services, including which pages and features are most and least used and how visitors move through the Site. If you do not allow these Cookies, Morning Health will not have the data necessary to monitor and optimize performance. Not used in mobile applications.

    Marketing

    Where applicable and subject to your consent, used by Morning Health and its advertising partners to build a profile of your interests and to attribute your sign-up or commercial interaction to the marketing channel from which you came (e.g., an affiliate link, a paid campaign, a social-media post). These Cookies do not store directly identifying personal information but are based on uniquely identifying your browser and device. If you do not allow these Cookies, you will experience less targeted advertising. Not used in mobile applications.

    4Third-Party Cookies and Sub-processors

    4.1. Third-party providers. Some Cookies described in Section 3 are set by third parties, including hosting providers, content-delivery networks, authentication providers, analytics providers, customer-support widgets, marketing-automation platforms and (where applicable) advertising partners. No specific third-party provider is guaranteed or incorporated by reference into this Cookie Policy. Morning Health may update, add, replace or discontinue third-party providers from time to time at its discretion.

    4.2. Independent processing. Each third-party provider's Processing of information collected through its own Cookies is governed by such third party's own privacy and cookie policies, which Morning Health does not control and is not responsible for. Users are encouraged to review the privacy policies of any third party before authorizing the corresponding category of Cookies.

    4.3. Consistency with Privacy Policy. Disclosure of Personal Data to third-party providers via Cookies operates consistently with Sections 6 (AI sub-processors), 8 (Disclosing Your Information) and 9 (International Data Transfers) of our Privacy Policy at morninghealth.ai/en/privacy.

    5Your Choices and How to Control Cookies

    5.1. Cookie banner / preference center. You may accept, reject or customize your Cookie preferences through the cookie banner displayed on the Site when you first visit and through the cookie preference center accessible at any time via the link displayed in the Site footer. Your preferences will be remembered subject to the lifetime of the Strictly Necessary Cookie that records them.

    5.2. Browser controls. You may also accept or refuse Cookies at the browser level through your browser settings. If you choose to refuse Cookies, you may still use the Site and the Services, although your access to certain functionality may be restricted. Browser-control mechanisms vary between browsers; please consult your browser's help menu for instructions specific to your browser.

    5.3. Opt-out of targeted advertising. Most advertising networks offer mechanisms to opt out of targeted advertising.

    5.4. CCPA/CPRA — "Do Not Sell or Share My Info". California residents may opt out of the "sale" or "sharing" of their Personal Data by submitting a request to privacy@morninghealth.ai.

    5.5. Withdrawal of consent. Where Morning Health relies on your consent to set non-strictly-necessary Cookies, you may withdraw such consent at any time through the cookie preference center, without prejudice to Cookies set prior to withdrawal.

    6Do Not Track / Global Privacy Control

    6.1. Legally recognized signals. Morning Health honors legally recognized opt-out preference signals (such as the Global Privacy Control, "GPC") to the extent required by Applicable Law, in respect of categories of disclosure that may be deemed "sale" or "sharing" under the CCPA/CPRA.

    6.2. Generic "Do Not Track". Morning Health does not currently respond to generic "Do Not Track" browser signals, as no industry or legal standard governing such signals has been finalized.

    7Changes to This Cookie Policy

    Morning Health may modify this Cookie Policy from time to time in order to reflect, by way of illustration and not limitation, (i) changes to the Cookies used; (ii) changes to third-party providers; (iii) operational, legal or regulatory developments. The updated Cookie Policy shall be published on the Site with a revised Effective Date. Continued use of the Site or the Services after the new Effective Date constitutes binding acceptance of the updated Cookie Policy. Where a modification materially expands Morning Health's tracking activities, Morning Health shall use commercially reasonable efforts to notify affected Users with reasonable prior notice, consistent with Clause 3.4 of the T&C and Section 17 of the Privacy Policy.
